Abok Ayuba has been reinstituted as Speaker of the state Legislature by the Jos-based Plateau State High Court. On October 28, 2021, the assembly members removed Ayuba from office.
Two members of the House, Gwottson Fom, who represents the Jos South Constituency, and Tyem Pirfa Jinfa, who represents the Langtang North North Constituency, sought the court to seek redress because they were dissatisfied with the procedure that resulted in the impeachment of Abok.
They requested, among other things, a declaration that the Plateau State House of Assembly’s meeting on October 28, 2021, between 6:00 a.m. and 7:00 a.m. is illegal, null, and void because it is unparliamentary and in violation of Order 6 rule of the state assembly regulations.
The claimants likewise requested that the court declare
The claimants also asked the court to rule that the removal of Ayuba was done in a way that violated Order 7 Rule 4 of the State Assembly Rules 202 and Section 92 (2) (c) of the Federal Republic of Nigeria, 1999, as amended, and that it was, as a result, unconstitutional, null, void, and of no effect.
Another remedy requested by the claimants is that Section 92(2) was broken when the first defendant, Ayuba, was removed from his position as Speaker of the State Legislature by votes of fewer than two-thirds of the House members, or 16 votes (c).
Chuwang Paul, the claimants’ attorney, stated that the judge had taken into account all of his client’s requests as well as the facts that the
While granting an injunction to prevent the current Speaker, Yakubu Sanda, from misrepresenting himself as the speaker of the state Legislature, Judge Nafisat Lawal Musa reinstated Ayuba as the assembly’s speaker in her ruling.
The court then made a subsequent judgment mandating that the reinstated Speaker be paid all remuneration, salary, bonuses, and allowances from October 28, 2021, until the end of his time as Speaker. The court ordered that N20 million be given as exemplary damages to the claimants.
The reinstated Speaker showed up at the state Assembly complex shortly after the verdict was delivered.
He added in a statement to journalists: “We are here on the premises of the House of Assembly because all of us were elected to represent our constituencies.
